Tyler and Cameron Winklevoss are not giving up. The brothers, who claim that they, not Mark Zuckerberg, came up with the idea for Facebook, are asking a federal appeals court in San Francisco to rehear their request that a 2008 settlement between them and Facebook be nullified so that they can pursue their original case against the company.
Mr. Falk also said: “This appeal is not about whether our clients would be better off keeping the settlement proceeds (which admittedly are substantial) rather than proceeding with their lawsuit against Facebook. That is up to them to decide; it is not a question for the courts.”
The settlement, initially valued at $65 million, is now worth approximately $200 million.
